Lengthy process for Council to take charge of estates
Leitrim County Council said it acknowledges that residents of various developments may be aggrieved by the length of the taking in charge process.
Answering questions from Cllr Gerry Reynolds, the Council said “the Authority must ensure that any development being taken into charge is completed to a satisfactory standard. In addition, as an estate is private property, in the ownership of a developer, the Planning Authority cannot simply take an estate into public charge without complying with the relevant legislative provisions.”
The council said that it has not received applications requesting the taking in charge of Lis Cara Estate, or Cnoc na Si Carrick-on-Shannon.
The planning authority has a request for taking in charge of Cluain Si. They “are currently waiting on the developer to revert back with confirmation that the outstanding remedial works have been completed. In the absence of such confirmation from the developer the taking in charge of the estate lies in abeyance.”
They also said that works on Shannon Grove are nearing completion and the Planning Authority is currently engaged with the developer in relation to finishing the development. “The developer has advised that he hopes to have the works completed by mid October. Upon completion of the works it is anticipated that the developer shall make a request to have the estate taken in charge. Upon receipt of a request the taking in charge process can commence.”
In answer to questions by Cllr Tony Ferguson, Leitrim County Council said the responsibility for grass cutting of the open spaces in housing estates which have been taken charge of rests with the residents of the estate. The council also said the vast majority of housing estates in Leitrim are located within a town or village where the speed limit is in general 50kph. Whilst the speed limit within estates is generally 50kph, cognisance must be taken of the fact that this is the maximum permissible speed and drivers are obliged to drive with due care and attention for the conditions. In housing estates, or built up areas in general, drivers must make allowances for children and parked vehicles and reduce their speed accordingly. The erection of ‘Speed Control’ type signs is considered unnecessary as the driver of a vehicle is already within a speed control zone, ie the general 50kph limit, that is in place in the town.
