Garda's evidence was "rock steady" in drink driving case

Mark Canning, Creenagh, Mohill was convicted, fined €250 and disqualified from driving for two years for drink driving at Main St, Dromod Beg, Dromod on July 25, 2020.
The case had been previously heard at Carrick-on-Shannon District Court and Judge Sandra Murphy had sought submissions from the prosecution and defence on a point raised about whether Garda Mimnagh had knowledge that Mr Canning had consumed alcohol 20 minutes before the alcolyser test was administered.


Judge Murphy complimented both submissions and said the garda’s evidence was “rock steady”, she believed that Gda Mimnagh “did not have knowledge Mr Canning consumed alcohol 20 minutes before the test.”
Both sides said their case was closed.
The court heard the alcohol reading was 52mcg of alcohol per 100 millilitres of breath.
Mr Canning had no previous convictions.
Solicitor Colm Conway said his client is 45-years-old and a father to one child, his driver's licence is important for his work as a sales rep.
Recognisances were fixed in case of an appeal.
