Separation of Family Law and criminal cases coming, says Leitrim Judge

Discussing a case in Manorhamilton District Court on Wednesday, February 8, Judge Sandra Murphy stated “Family Law needs to be separated” from the criminal court list.


She added that this separation is “coming” but that it could be “two years away.”
At the moment Family Law cases take their place in the court list alongside criminal cases.


The issue arose when a solicitor put forward an application for a criminal case to be held at a special sitting of Sligo District Court and not for the hearing to take its place in the scheduled sitting this week.


The solicitor said that Judge Sandra Murphy had heard elements of the case from a family law perspective in relation to domestic violence.


Judge Murphy said district court judges deal with similar issues regularly and are not biased when cases cross between Family Law and criminal.


Speaking about the evidence the judge may have heard in a Family Law setting, the solicitor commented “once heard though, you cannot unhear it.”
