Simon Stokes, a 32-year-old father of three from 13 Maighglas Liscara, Carrick on Shannon, appeared in court recently to face charges related to texting while driving. On July 19 2024, Stokes was involved in an incident on the N4 between Rooskey and Dromod, where he was seen holding a mobile phone in his right hand while operating his vehicle.
The defendant, married with three children, expressed to the court that he was unable to pay the fine associated with the charge at the time it was issued. "I simply didn’t have the money to pay the fine," he explained to Judge Sandra Murphy. He also confirmed that he understood the seriousness of the situation and the potential consequences, including the risk of additional penalty points on his driving record.
Judge Sandra Murphy, known for her tough stance on road safety, addressed the defendant sternly. “It’s very serious,” she said. “I’ve seen fatal accidents caused by texting while driving, and it takes very little for something terrible to happen." The judge emphasized the dangers of texting behind the wheel and questioned Stokes if there was ever any emergency that would justify texting while driving. Stokes answered no, acknowledging the risks involved.
The court was informed that the defendant is a social welfare recipient, receiving family payments. However, financial strain made it impossible for him to pay the fine at the time it was issued. His legal representative explained that he accepts full responsibility for his actions.
After hearing the facts of the case, Judge Murphy convicted the defendant and imposed a fine of €350 with six months to pay, as well as five penalty points on his driving record. "I’ve seen firsthand the devastating effects of texting while driving.It can be fatal," Judge Murphy added. "You have to take responsibility for your actions, and you will have to pay the fine."
