Leitrim County Council have confirmed that they do not intend to take in charge a car park in Manorhamilton.
At the January meeting of Manorhamilton Municipal District, Cllr Pádraig Fallon proposed that the possibility of taking in charge the car park to the rear of Dillon Court in Manorhamilton be examined.
Dillon Court is a 27-apartment housing development located on Church Lane in the town. An official response explained that the taking in charge of a housing development by a local authority can only occur where certain legal conditions are met.
One such condition is that the development must include a road that is of general public use, a requirement which the Dillon Court car park does not satisfy.

Another condition outlined is that a formal request to take the development in charge must be made either by the developer or by a majority of the property owners.
“The Council has not been requested to take the development in charge by any party with a legal entitlement to make such a request. Even should such request a be received the Council notes that the development does not include a road that would be considered to be of general public utility and so it does not satisfy the requirements for taking in charge under Section 180 of the Planning and Development Act, 2000,” the response stated.
The response further noted that the car parking at Dillon Court is for the sole use of the occupants of the apartments and is already at the minimum level required, leaving no capacity for any area to be considered for public parking.
“In light of the foregoing the Council does not intend to consider this development for taking in charge,” the response concluded.
