A County Leitrim resident who had four previous convictions for driving with no insurance had his case put back for a probation report, at Ballyshannon District Court.
Wayne Fernandez (56) for Duncarbery Orchard, Tullaghan, Co Leitrim pleaded guilty to the charge that happened at Tullaghan on March 2 last year.
The court was told that this would be his fifth conviction for that offence, and he had 32 convictions in total.
Defence solicitor Tom MacSharry said his client had a very serious record and as a younger man he was trained to work with cars, fixed them up and sell them on.
At the time of this offence, he was financially put to the pin of his collar.
The defendant admitted that he had no insurance and was very much aware that he was in the frame for prison.
Mr MacSharry asked the court to consider a probation report with a view to having a community service order which the defendant did not have a chance to carry out up to now.
The solicitor said the defendant was “fit and healthy” and would like to give something back to the community and a probation report would be a useful tool.
Judge Sandra Murphy said she would consider a CSO.
The court heard the defendant was banned from driving after the offence before the court.
Mr MacSharry said the defendant would not be driving and won’t be in the future and “you will not see him behind the wheel of a car again.”
Judge Murphy adjourned the case to July 1 to for a probation report to consider a CSO.
